These terms are the agreement between you and Nodogames, LLC about using the A1cMealPrep app. Please read them. The most important part is that the app is not medical advice.

Who can use the app

You must be 18 or older, or the age of majority where you live. You must live in a country where we offer the app: the United States, Canada, the United Kingdom, the European Economic Area or Switzerland. The app is for personal use.

A1cMealPrep is made for adults with prediabetes or type 2 diabetes who don't use insulin, and for the people who cook for them. It isn't designed for type 1 diabetes, diabetes in pregnancy or people who take insulin. If that's you, ask your care team before using it.

Your account

You need an account to use the app. You make it with Sign in with Apple or Sign in with Google, after the sample plan and the subscription offer, whether or not you subscribe. Your settings (such as household size, budget and region) are saved to your account. To save your health answers, plans and shopping list to it as well, you also turn on "Plan with my health info"; without it they stay on your phone. You're responsible for your device and the Apple or Google Account you sign in with. Tell us if you think someone else has used your account. You can delete your account at any time in Me → Privacy & data → Delete my account.

Subscriptions and the free trial

You can see a sample day and a shopping list preview for free. A subscription unlocks new weekly plans, swaps and the rest of the app. There are two plans:

• Annual: US$59.99 a year, with a 1-week free trial for new subscribers.
• Monthly: US$9.99 a month, with no free trial.

The price you see in the app before you buy is the price you pay. It's shown in your local currency. Taxes may be added, depending on where you live. Prices can change, and Apple will tell you before a change takes effect.

• Billing. Apple charges your Apple Account when you confirm the purchase, or, after a free trial, when the trial ends. We never see your card.
• Free trial. Apple decides who can get a free trial, and you can get it once. Cancel at least 24 hours before it ends and you pay nothing. If you don't, it turns into the annual plan. If you allow notifications, we send a reminder 2 days before the trial ends. That's a courtesy, so check the date in your Apple Account too.
• Renewal. Subscriptions renew automatically for the same period until you cancel. Apple charges for the next period within 24 hours before the current one ends.
• Cancelling. Cancel any time in Settings → Apple Account → Subscriptions. You keep access until the end of the period you've paid for. Deleting the app or your account doesn't cancel a subscription.
• Refunds. Apple handles payments, so ask Apple: go to reportaproblem.apple.com. We can't refund purchases made through the App Store. Where the law gives you a right to cancel or a refund, it applies through Apple.
• Restoring. If you subscribed before, use "Restore purchases" on the paywall to get access back on a new device.
• When a subscription ends. You keep your last plan, shopping list and eating guide to read. Making new plans and swapping meals needs a subscription.

Using the app

Use the app only for yourself and your household, and only as we intend. You agree not to:

• copy, resell or share the app, its recipes or its data, or use them to build a competing service;
• reverse engineer the app, scrape it, or call our servers in ways other than through the app;
• get around the subscription, security or rate limits, or overload our servers;
• use the app to give medical or dietary advice to others as a business;
• break the law or other people's rights with it.

AI-generated recipes and images

The recipes in A1cMealPrep are written by an AI model and checked automatically. The checks cover carb range, allergens and dislikes, cooking times, safe cooking temperatures and sensible amounts. We also spot-check a sample of new recipes. The carb, fibre and cost figures aren't written by the AI. They are calculated from food and price data.

Even so, a recipe can contain a mistake. Use your own judgement, cook food safely, and check allergens yourself.

The pictures of dishes and ingredients are AI-generated illustrations, and they're labelled that way. Your finished dish will look different.

Estimates, data and sources

Carb figures come from food composition databases and are estimates. Real foods and brands vary, and so does how you cook and portion them. Food prices are estimates based on official average-price data, not the price at your store. Health guidance in the app is drawn from published sources and is general. It isn't advice for your situation.

Our rights in the app

The app, its recipes, text, design and code belong to Nodogames, LLC or our licensors. We give you a personal, limited, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, under these terms and Apple's rules. You keep ownership of what you enter, such as your answers and ratings. You give us permission to use them to run the app for you, as our Privacy Policy describes.

If you send us feedback, we may use it without owing you anything.

Your data

Our Privacy Policy and Consumer Health Data Privacy Policy explain what we collect and the choices you have.

Changes and ending things

We may change or stop features, for example to keep the app safe or legal. We'll give notice of any change to these terms that affects you in a significant way, in the app or by email. If you keep using the app after that, you accept the change. If you don't accept it, stop using the app and delete your account.

You can stop using the app at any time. We may suspend or end your access if you break these terms or misuse the app.

Warranties and liability

We work to make the app useful and accurate, but we provide it "as is" and "as available". As far as the law allows, we don't promise that it will be error-free, always available or right for your situation, and we don't give any implied warranties.

As far as the law allows, we aren't liable for indirect or consequential loss, lost profits or lost data, or for harm that comes from relying on a carb figure, a recipe, a price or any other content in place of medical advice. Our total liability to you for anything connected with the app is limited to the amount you paid us in the 12 months before the claim. [TO CONFIRM: liability cap]

Nothing in these terms limits liability that can't be limited by law. That includes liability for death or personal injury caused by negligence, for fraud, and for anything else the law doesn't allow us to exclude. If you're a consumer, you keep the rights you have under the consumer laws where you live.

Apple's terms

• These terms are between you and Nodogames, not Apple. Apple isn't responsible for the app or its content, and has no duty to provide maintenance or support.
• Apple's standard Licensed Application End User License Agreement also applies. If it conflicts with these terms about the licence to use the app, Apple's terms prevail.
• If the app doesn't meet a warranty that applies to it, tell Apple, and Apple may refund the purchase price. To the extent the law allows, Apple has no other warranty duty for the app.
• We, not Apple, deal with any claims that the app infringes someone's intellectual property, or about product liability, legal compliance or consumer protection.
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
• You confirm that you aren't in a country under a US government embargo or on a US government list of restricted parties.

Governing law

These terms are governed by the laws of the State of [GOVERNING LAW STATE] and the United States, without regard to conflict-of-law rules. Courts in [GOVERNING LAW STATE] have jurisdiction, unless the law gives you the right to bring a claim where you live. If you're a consumer in the EU, the UK or Canada (including Quebec), you keep the protection of your country's mandatory laws and can bring claims in your local courts. If part of these terms isn't enforceable, the rest still applies.
